1. Agreement

These terms govern your use of nextgentechuae.com (the “Site”) and of the NextGenTech products — NextGenTech CRM, NextGenTech CMMS and LaundryPro / SmartLaundry— with their web portals and mobile apps (together the “Services”), provided by NextGenTech IT Systems LLC, Shams Business Center, Sharjah Media City Free Zone, Al Messaned, Sharjah, UAE (“NextGenTech”, “we”). By using the Services you agree to these terms. Organisations that subscribe to a product (“Customers”) are additionally bound by their subscription agreement, which prevails over these terms if they conflict.

2. Accounts

You must provide accurate information when creating an account and keep your credentials confidential; you are responsible for activity under your account. Staff, vendor and driver accounts in CRM, CMMS and LaundryPro are created by the subscribing Customer, which controls access and may suspend or remove them at any time. Consumers using the SmartLaundry customer app create their own account and must be at least 18.

3. Acceptable use

You agree not to:

• use the Services for any unlawful purpose or in breach of UAE law;
• upload content that is infringing, defamatory, malicious or that you have no right to share;
• attempt to gain unauthorised access to the Services, other accounts or our systems;
• interfere with the Services’ operation or place unreasonable load on them;
• reverse-engineer, copy or resell the Services except as permitted by law or your subscription.

4. Your content

You (or the Customer you work for) retain ownership of the data, documents and photos you enter into the Services. You grant us the licence needed to host, process, back up and display that content in order to provide the Services. Our handling of personal data is described in the Privacy Policy.

5. Intellectual property

The Services, including software, design, text and the NextGenTech, CRM, CMMS, LaundryPro and SmartLaundry names and logos, are owned by NextGenTech or its licensors and protected by intellectual-property law. No rights are granted except as expressly stated in these terms or a subscription agreement.

6. Mobile apps

Our mobile apps — NextGenTech CRM, CMMS, SmartLaundry and SmartLaundry Driver — are licensed, not sold, to you for use only on devices you own or control and as permitted by the app-store terms (Apple App Store or Google Play). The CRM, CMMS and Driver apps require an account provisioned by a subscribing Customer. Apple Inc. and Google LLC are third-party beneficiaries of this section and have no obligation to provide maintenance or support for the apps. App updates may be required to keep using a product.

7. Orders and payments (LaundryPro / SmartLaundry)

When you place a laundry order through the SmartLaundry app or portal, the contract for the laundry service is between you and the laundry business operating that branch; NextGenTech provides the software only. Prices, turnaround times, cancellations and refunds are set by that business. Card payments are processed by Stripe under its own terms; NextGenTech does not store full card numbers.

8. Subscriptions and trials

Product subscriptions are governed by the Customer’s subscription agreement and order form. Free trials are offered at our discretion, may be limited in duration or features and may be withdrawn at any time; data in a trial tenant may be deleted 30 days after the trial ends.

9. Availability and support

We aim for high availability but the Services may be interrupted for maintenance, updates or causes outside our control. Support is provided to Customers under their subscription agreement; end users should contact their organisation’s administrator first.

10. Disclaimer and liability

The Services are provided “as is” and, to the extent permitted by law, without warranties of any kind. NextGenTech is not liable for indirect, consequential or special losses, loss of profit, data or business arising from use of the Services, nor for the acts or services of Customers that use our products (for example a laundry business or a professional-services firm). Our total liability under these terms is limited to the amount you (or your Customer) paid us for the Services in the 12 months before the claim. Nothing limits liability that cannot be limited by law.

11. Termination

We may suspend or terminate access to the Services for breach of these terms. Customers may terminate as set out in their subscription agreement. On termination your right to use the Services ends and we may delete your data after the retention periods in the Privacy Policy.

12. Governing law

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Sharjah, and the courts of Sharjah have exclusive jurisdiction over any dispute.

13. Changes

We may update these terms by posting a new version on this page with an updated date. Continued use of the Services after a change constitutes acceptance.
